1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Creator," or "you") and PromoFast ("PromoFast," "we," "us," or "our") governing your access to and use of the PromoFast platform, including the website, creator dashboard, campaign marketplace, analytics tools, payment features, and all related services (collectively, the "Platform"). The Platform enables Telegram channel owners and social promoters to discover brand campaigns, publish promotional content, earn compensation based on verified views, and request withdrawal of eligible balances.

By creating an account, clicking acceptance buttons, accessing the Platform, or participating in any campaign, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Platform. We may modify these Terms at any time, and your continued use after changes become effective constitutes acceptance of the revised Terms unless applicable law requires otherwise.

These Terms apply to all users, including registered creators, visitors browsing public content, and any person acting on behalf of an organization that uses the Platform. If you use the Platform on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

2. Account Creation and Eligibility

To access creator features, you must register for an account and provide accurate, current, and complete information as prompted during registration, including your name, email address, telephone number, and password. You agree to maintain and promptly update your account information to keep it accurate. Providing false, misleading, or incomplete information may result in suspension or termination of your account.

You must be at least 18 years of age and legally capable of entering into binding contracts in your jurisdiction to use the Platform. By registering, you represent and warrant that you meet these eligibility requirements. PromoFast reserves the right to refuse registration, reclaim usernames, or terminate accounts at its sole discretion where permitted by law.

2.1 Account Security

You are responsible for safeguarding your login credentials and for all activities that occur under your account. You must notify PromoFast immediately of any unauthorized use or suspected breach of security. We are not liable for losses arising from unauthorized access where you have failed to maintain reasonable security practices. You may not share your account with others or create multiple accounts to circumvent restrictions, payout limits, or campaign eligibility rules.

3. User Responsibilities

As a user of the Platform, you agree to use the services lawfully, ethically, and in accordance with these Terms, campaign-specific instructions, and applicable regulations governing advertising, consumer protection, and telecommunications in your region. You are solely responsible for the content you publish on Telegram or other channels, for ensuring that your promotional activity complies with local law, and for any tax obligations arising from earnings received through the Platform.

You must maintain control over any Telegram channel or social property you register or associate with PromoFast. You may not misrepresent audience size, engagement metrics, channel ownership, or geographic reach. You are responsible for reviewing campaign briefs carefully before enrollment and for fulfilling all posting requirements within specified timeframes.

You agree not to interfere with the proper functioning of the Platform, including by introducing malware, attempting unauthorized access, scraping data without permission, or overloading infrastructure through automated requests. You must cooperate with reasonable verification requests related to campaign compliance, identity confirmation, or payout processing.

4. Campaign Participation

Campaigns listed on the Platform are offered by brand partners and administered through PromoFast tools. Campaign availability, reward rates, budget caps, eligibility criteria, and posting requirements are displayed at the time of enrollment and may change without prior notice for future campaigns. Enrollment in a campaign constitutes your agreement to comply with all campaign-specific rules in addition to these Terms.

PromoFast does not guarantee that any campaign will remain available for any minimum duration or that budget will not be exhausted before you complete enrollment. Once you join a campaign, you are expected to publish approved content according to the brief, maintain the post for any required visibility period, and submit verification links or materials as instructed. Failure to complete required steps may result in forfeiture of earnings associated with that campaign.

4.1 Campaign Modifications

Brands and PromoFast may modify campaign creatives, disclosure requirements, or compliance rules when necessary to address legal, technical, or brand safety concerns. Material changes affecting active participants will be communicated through the dashboard or email where practicable. Continued participation after notification may constitute acceptance of modified requirements.

5. Content Submission

Creators submit promotional content by publishing posts on Telegram or other approved channels and providing verification data through the Platform. Submissions must use creatives, copy, links, and disclosure formats provided or authorized by the campaign unless otherwise expressly permitted. You may not alter branded assets in ways that misrepresent the advertiser or violate intellectual property rights.

You represent that your channel content and promotional posts do not infringe third-party rights, contain unlawful material, or violate Telegram community guidelines or applicable advertising standards. You are responsible for ensuring that sponsored content is clearly identified as promotional where required by law or platform policy. PromoFast may reject or request revision of submissions that do not meet quality or compliance standards.

Submission timestamps, URLs, and performance data form part of the official record used to calculate earnings. You must not delete or hide required posts before the end of any mandated visibility period unless authorized by PromoFast or the campaign terms.

6. View-Based Earnings

Creator compensation on PromoFast is primarily calculated based on verified views attributable to qualifying campaign posts, according to the rate, cap, and measurement methodology stated at campaign enrollment. "Verified views" means views counted through PromoFast measurement systems and subject to fraud filters, deduplication, and campaign-specific rules. Reported view counts on Telegram or third-party tools may differ from verified counts used for payout purposes.

Earnings accrue only after submissions pass verification and remain subject to adjustment for invalid traffic, policy violations, measurement corrections, or chargebacks from brand partners. PromoFast may apply hold periods before earnings become available for withdrawal to allow for audit and dispute resolution. Displayed balances are estimates until finalized through internal reconciliation processes.

6.1 Measurement Disputes

If you disagree with verified view counts or earnings calculations, you must raise a dispute through support channels within the timeframe specified in campaign materials or dashboard notices. PromoFast will review disputes in good faith but retains final authority over measurement methodology and payout determinations consistent with these Terms.

7. Payment Eligibility and Withdrawals

Withdrawal of earnings is available only to creators who have completed identity and payout setup requirements, linked a valid bank account or approved payment method, and accumulated an available balance meeting the minimum cashout threshold displayed on the Platform. PromoFast may impose additional verification steps for large withdrawals, unusual activity, or first-time payout requests.

Available balance excludes amounts under review, subject to hold, disputed by brand partners, or clawed back due to policy violations. You are responsible for providing accurate bank details and for any fees charged by financial institutions. PromoFast is not liable for delays caused by incorrect account information, banking holidays, or third-party payment processor outages.

PromoFast reserves the right to refuse, reverse, or delay payouts where fraud is suspected, campaigns are invalidated, or legal restrictions apply. Earnings may be denominated in Indian Rupees or other currencies as indicated in the dashboard, subject to conversion policies where applicable.

8. Fraud Prevention

PromoFast maintains systems and procedures to detect fraudulent activity, including artificial view inflation, bot traffic, click farms, duplicate accounts, self-referential schemes, and misrepresentation of channel metrics. Participation in or facilitation of such activity is strictly prohibited and may result in immediate account termination, forfeiture of earnings, and referral to law enforcement.

We may use automated risk scoring, manual review, and third-party fraud detection tools to evaluate submissions and payout requests. You agree to cooperate with investigations by providing requested documentation or explanations. PromoFast's determination regarding fraudulent conduct is final for Platform purposes, without prejudice to rights available under applicable law.

9. Platform Abuse

Platform abuse includes any conduct that harms PromoFast, brand partners, other creators, or the integrity of the marketplace. Prohibited behavior encompasses harassment of support staff, circumvention of technical controls, exploitation of software vulnerabilities, unauthorized resale of campaign access, and coordination of inauthentic engagement.

PromoFast may monitor Platform activity to identify abuse patterns and take corrective action ranging from warnings and feature restrictions to permanent bans and legal action. Abuse determinations are made based on available evidence, which may include logs, submission metadata, third-party reports, and campaign audit findings.

10. Suspension and Termination

PromoFast may suspend or terminate your account at any time, with or without notice, if you violate these Terms, campaign rules, applicable law, or if we reasonably believe your conduct poses risk to the Platform or third parties. Suspension may limit access to campaigns, freeze withdrawals pending review, or disable login entirely depending on severity.

You may terminate your account by contacting support or using account closure features if available. Termination does not relieve you of obligations incurred prior to closure, including repayment of improperly obtained earnings or liability for breaches of these Terms. Sections that by their nature should survive termination will remain in effect, including intellectual property provisions, disclaimers, and limitations of liability.

10.1 Effect on Earnings

Upon termination for cause, PromoFast may withhold or cancel pending earnings associated with fraudulent, incomplete, or non-compliant campaign activity. Earnings from legitimate, fully verified campaigns may still be paid subject to standard withdrawal requirements and applicable holds, at PromoFast's discretion consistent with law.

11. Intellectual Property

The Platform, including its software, design, trademarks, logos, documentation, and proprietary analytics methodologies, is owned by PromoFast or its licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from Platform materials without prior written consent.

Campaign creatives, brand names, and advertising assets provided through campaigns remain the property of respective brand partners or licensors. Your use of such materials is limited to executing authorized campaigns in accordance with campaign terms. Unauthorized use outside campaign scope constitutes infringement and may result in termination and legal liability.

12. Content Ownership and License

You retain ownership of original content you create independently of campaign assets, subject to licenses granted herein. By participating in campaigns and using Platform features, you grant PromoFast a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and analyze your submissions, profile information, and associated performance data for purposes of operating the Platform, verifying compliance, reporting to brand partners, and improving services.

This license includes the right to sublicense performance metrics and anonymized content excerpts to brand partners for campaign reporting. The license continues for a reasonable period after account termination to the extent necessary for audits, disputes, and legal compliance. You represent that you have all rights necessary to grant this license.

13. User Conduct

You agree not to engage in conduct that is defamatory, obscene, discriminatory, threatening, or otherwise objectionable in connection with Platform use. You may not use the Platform to promote illegal products, deceptive schemes, hate speech, or content that exploits minors. Creators must respect audience expectations and publish sponsored content in a manner consistent with applicable disclosure norms.

Harassment of other users, brands, or PromoFast personnel through any channel connected to Platform activity is prohibited. Violations may result in removal from campaigns, account restrictions, and referral to relevant authorities where appropriate.

14. Platform Limitations and Availability

PromoFast strives to maintain reliable Platform availability but does not guarantee uninterrupted or error-free service. Maintenance, upgrades, third-party outages, and events beyond our reasonable control may cause temporary disruptions. We may modify, suspend, or discontinue features with or without notice, and we are not liable for changes that do not materially deprive you of earned balances already finalized for withdrawal.

The Platform is provided as a marketplace intermediary connecting creators and brand campaigns. PromoFast is not a party to direct advertising contracts between you and brands except as necessary to administer campaigns and payments. We do not guarantee any minimum earnings, campaign volume, or continued access to specific brands.

15. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PROMOFAST DOES NOT WARRANT THAT EARNINGS WILL MEET YOUR EXPECTATIONS, THAT VIEW COUNTS WILL MATCH THIRD-PARTY ANALYTICS, OR THAT CAMPAIGNS WILL REMAIN AVAILABLE INDEFINITELY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMOFAST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE GREATER OF AMOUNTS PAID TO YOU THROUGH THE PLATFORM IN THE TWELVE MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY APPLICABLE LAW.

16. Payment Disputes

Payment disputes must be submitted through official PromoFast support channels with sufficient detail, including campaign name, submission date, and the nature of the disagreement. We will acknowledge receipt and review disputes within timeframes communicated in the dashboard or support responses. PromoFast may request additional evidence before rendering a decision.

Decisions regarding verified views, eligibility, and payout amounts are binding for Platform purposes unless overturned through formal legal proceedings. You agree to attempt good-faith resolution through PromoFast before initiating external proceedings where practicable. Nothing in this section limits rights that cannot be waived under applicable consumer protection law.

17. Account Restrictions

PromoFast may impose restrictions on accounts that exhibit elevated risk, including limits on campaign enrollment, reduced withdrawal frequency, mandatory additional verification, or temporary holds on earnings. Restrictions are applied to protect the marketplace and may be lifted upon satisfactory completion of review procedures.

Attempting to evade restrictions by creating new accounts, using alternate identities, or manipulating device identifiers is prohibited and may result in permanent termination of all associated accounts and forfeiture of pending balances linked to abusive conduct.

18. Security Obligations

You must implement reasonable security practices when using the Platform, including protecting credentials, securing devices used to access your account, and promptly reporting suspected compromises. You may not attempt to probe, scan, or test the vulnerability of Platform systems without authorization.

PromoFast implements security measures described in our Privacy Policy but cannot guarantee absolute protection against all threats. You acknowledge that transmission of information over the internet carries inherent risks and that you provide information at your own risk to the extent permitted by law.

19. Policy Changes

PromoFast may update these Terms, campaign policies, payout schedules, and related guidelines periodically. Material changes will be communicated by posting updated Terms on the Platform, updating the effective date, and where appropriate providing notice via email or dashboard alerts. Your continued use after the effective date of changes constitutes acceptance unless you terminate your account before the changes take effect.

If you do not agree to revised Terms, you must stop using the Platform and may request withdrawal of eligible finalized balances subject to standard verification and minimum thresholds. Some changes may be required immediately by law or security necessity and will be effective upon posting.

20. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PromoFast operates its principal business, without regard to conflict of law principles, except where mandatory consumer protections in your country of residence apply. Any dispute arising from these Terms or Platform use shall first be addressed through good-faith negotiation between you and PromoFast.

If negotiation does not resolve the dispute within a reasonable period, either party may pursue remedies available under applicable law, including arbitration or litigation in courts of competent jurisdiction as specified in supplemental agreements or mandatory local law. Class action waivers and jury trial waivers may apply where enforceable.
